Terms and Conditions

Welcome to Gigabits, LLC (“Gigabits”, “we”, “us”, or “our”). By accessing or using our website gigabitstech.com, purchasing products or services, or engaging in any business with us, you agree to the following terms and conditions. Please read them carefully.

1. Warranty Terms

1.1 Labor Warranty – 7 Days

All work performed by Gigabits is covered under a labor-only 7-day warranty, starting from the date listed on your invoice.
If the same issue re-occurs within this period, we will re-service the issue at no labor charge. However, charges will apply for any new or additional parts required.
Exclusions: Labor warranty does not cover:

  • Software faults

  • Viruses or malware

  • User errors

1.2 Hardware Warranty – 30 Days Return-to-Shop

New hardware purchased from Gigabits comes with a 30-day return-to-shop manufacturer’s warranty.
After 30 days, customers must contact the manufacturer directly for warranty claims.

Please note:

  • Some hardware, software, and components may be third-party products.

  • Manufacturer warranties may vary in coverage and duration.

1.3 Non-Warranty Repairs

We strive to complete repairs within a few days, depending on parts availability. All parts used for non-warranty repairs are manufacturer-supplied, unless otherwise requested by the customer.

1.4 Warranty Exclusions

The following are not covered under any warranty:

  • Accidental damage (e.g., liquid spills, drops, or physical damage)

  • Cabinet or component breakage due to misuse

  • Damage from power surges/spikes (e.g., electrical, telecom lines)

  • Environmental causes: rust, corrosion, voltage or amperage fluctuations

  • Acts of God: fire, flood, earthquake, storms, or theft

  • War or terrorism-related events

  • Equipment with warranty stickers removed, broken, or tampered with

  • Failures caused by inadequate maintenance or "fair wear and tear"

  • Incompatibility-related issues or user-induced errors

2. Payment Terms

  • Full payment is due upon completion of services.

  • Accounts unpaid after 14 days of the invoice date will incur a 5% late fee per week of delinquency, or the maximum allowed by law.

  • If collection is required, the client is responsible for all associated fees (legal, administrative, etc.).

  • Gigabits may, at its sole discretion, waive or reduce fees in individual cases.

3. Abandonment of Property

Gigabits will make reasonable efforts to contact customers for pick-up of their property.
If a customer fails to retrieve their device or equipment within 90 days from the original drop-off date, they agree to relinquish ownership of said property to Gigabits, LLC.
We reserve the right to sell, recycle, or dispose of abandoned property to recover any unpaid service costs.

4. SMS/Text Communications

4.1 SMS Consent Communication

The information (Phone Numbers) obtained as part of the SMS consent process will not be shared with third parties for marketing purposes.
 

4.2 Types of SMS Communications

If you have consented to receive text messages from Gigabits, you may receive messages related to the following:

Appointment reminders
Follow-up messages
Billing inquiries
Promotions or offers (if applicable)
Example: "
Hi [Customer Name], this is [Technician Name] with Gigabits, I'm reaching out with an update on your computer and quote to repair, so when you have a chance please reply or give us a call at (912) 675-5779. Reply STOP to opt out of SMS messaging at any time."

4.3 Message Frequency

Message frequency may vary depending on the type of communication. For example, you may receive up to [X] SMS messages per week related to your [appointments/billing, etc.].
Example:
"Message frequency may vary. You may receive up to 2 SMS messages per week regarding your appointments or account status."

 

4.4 Potential Fees for SMS Messaging

Please note that standard message and data rates may apply, depending on your carrier’s pricing plan. These fees may vary if the message is sent domestically or internationally.
 

4.5 Opt-In Method

You may opt-in to receive SMS messages from Gigabits in the following ways:

By submitting an online form

 

4.6 Opt-Out Method

You can opt out of receiving SMS messages at any time. To do so, simply reply "STOP" to any SMS message you receive. Alternatively, you can contact us directly to request removal from our messaging list.
 

4.7 Help

If you are experiencing any issues, you can reply with the keyword HELP. Or, you can get help directly from us at (insert the link)
Additional Options:

If you do not wish to receive SMS messages, you can choose not to check the SMS consent box on our forms.

 

4.8 Standard Messaging Disclosures

Message and data rates may apply.
You can opt out at any time by texting "STOP."
For assistance, text "HELP" or visit our [Privacy Policy] and [Terms and Conditions] pages.
Message frequency may vary

 

5. Limitation of Liability

To the maximum extent permitted by law, Gigabits shall not be liable for any:

  • Indirect, incidental, or consequential damages

  • Data loss, profit loss, or business interruption

  • Unauthorized access to your devices or data

Clients are advised to back up data prior to service. Gigabits is not responsible for data loss or corruption.

6. Modifications to Terms

Gigabits reserves the right to update or modify these Terms and Conditions at any time without prior notice. Changes will be effective upon posting on our website. Continued use of our services constitutes acceptance of the revised terms.
